Membership Terms

1. Who we are and who may enroll
Next Standard Performance (“NSP,” “we,” “us”) is a coaching brand operated by Sky Hood Ventures LLC. Public NSP memberships are offered to people age 18 or older. A minor may participate only through a separately approved youth service and separate parent/guardian documentation; the public checkout on this site is not a minor enrollment path.
2. What NSP provides
NSP provides fitness, personal training and performance coaching services. Depending on the service purchased, this may include private exercise instruction, individualized programming, strength and conditioning, movement/mobility work, general fitness education, progress review, general recovery/lifestyle education, general nutrition/fueling education, online training programs, coaching communications and technique feedback on voluntarily submitted training videos.
NSP is not a medical practice, physical therapy practice, registered dietitian service, psychotherapy service or emergency service. We do not diagnose disease or injury, prescribe medication, provide medical nutrition therapy or promise treatment of a medical condition. Where medical evaluation or treatment is appropriate, the client is responsible for working with appropriately licensed professionals.
3. NSP coach assignment and delivery
Private coaching memberships may be delivered by qualified NSP employees or independent contractor coaches selected according to schedule, geography, capacity and coaching fit. Membership is with Next Standard Performance and does not promise a particular coach. NSP may change coach assignment when reasonably necessary while maintaining the contracted service level.
4. In person membership billing and initial commitment
In person private coaching memberships are billed monthly through Stripe. Unless a signed plan states otherwise, the membership begins with three monthly billing cycles and then continues month to month until canceled for future billing. The monthly fee reserves the selected weekly coaching cadence and the supporting program/progress management service.
NSP does not collect all three monthly payments upfront. Each recurring monthly payment is intended to cover services provided in the corresponding monthly service period. Arizona law contains an exemption for a health spa that does not require or ordinarily receive prepayment and states that payment for services received within the 31 days in which services are rendered is not prepayment. NSP does not rely on this sentence to eliminate any right that a court or regulator determines applies to a particular customer or contract.
5. Weekly cadence and calendar months
“1×, 2×, 3× or 4× weekly” describes the recurring coaching cadence, not a promise of exactly four, eight, twelve or sixteen sessions in every calendar month. Calendar months contain different numbers of weeks. Scheduled delivery remains subject to client attendance, agreed scheduling policies, reasonable holidays, facility closures, coach illness/emergencies and other reasonable operational adjustments.
6. Online Coaching
Online Performance Coaching is $399 per month unless the checkout expressly states a different current price. It is month to month and may be canceled for future renewal at any time. It includes a detailed onboarding process; individualized programming; one 30 minute Plan Build video call; direct coaching support with a normal response target within 24 hours; technique critique on training videos voluntarily submitted by the client; and general lifestyle/nutrition priorities within NSP’s non medical scope. The 24 hour target is an operating target, not an emergency response guarantee.
7. Payments, processed charges and refunds
Payments are processed by Stripe. Except where applicable law requires otherwise or NSP confirms a billing error or written exception, charges are nonrefundable once a billing period begins. NSP does not provide prorated refunds merely because a client stops using the service during an already paid period.
Client missed sessions, no shows, late arrivals and late cancellations do not create a cash refund, automatic credit or automatic carry forward. If reasonable notice is provided, NSP may offer a makeup when capacity permits, but a makeup is not guaranteed. A session canceled by NSP will be rescheduled or otherwise made good through service.
8. Arizona cancellation rights if applicable
Cancellation/support email: info@nextstandardperformance.com. Website cancellation path: nextstandardperformance.com/cancel. NSP’s physical mailing/personal delivery address is stated in the signed agreement and transactional contract copy using the business address configured for the service.
9. Scheduling and client responsibilities
Clients are responsible for arriving on time, wearing appropriate clothing/footwear, providing accurate health/training information, following reasonable safety instructions, using equipment as instructed and stopping exercise when concerning symptoms occur. Clients must not attend in person sessions while impaired by alcohol, recreational drugs or medications that make exercise unsafe.
10. Safety, medical clearance and emergencies
Exercise has inherent risks. The separate Assumption of Risk & Liability Waiver is incorporated into the enrollment agreement. NSP may require medical clearance or decline/modify exercise when information presented to the coach reasonably raises a safety concern. NSP may call emergency services if staff reasonably believe emergency assistance is warranted; associated medical costs remain the client’s responsibility.
11. Privacy, photos and client publicity
NSP does not require progress photos as a condition of coaching. Clients are not required to post, tag NSP, publish results or participate in marketing. NSP will not publish a client’s name, identifiable image, testimonial, body composition result or transformation story for advertising without separate, affirmative permission that is distinct from the membership agreement. A client may decline publicity without losing access to coaching.
Training videos voluntarily provided for technique critique are coaching material. They are not automatically authorized for advertising or public posting.
12. No guaranteed outcomes
Results depend on many factors outside NSP’s control, including attendance, effort, sleep, nutrition, health status, adherence, genetics, stress and life circumstances. NSP does not guarantee weight loss, muscle gain, pain relief, strength gains, athletic performance, appearance changes, medical outcomes or any other specific result. Any client examples or testimonials reflect individual experiences.
13. Online service responsibilities
Remote clients choose and control their own training environment. They are responsible for having sufficient safe space, stable equipment, appropriate loads and internet/device access, and for stopping activity when unsafe conditions or concerning symptoms arise. Remote technique feedback cannot identify every risk that in person observation or medical evaluation might identify.
14. Communications
Membership/service communications necessary to administer or deliver coaching are transactional and do not depend on optional marketing consent. Marketing emails are sent only where permitted and include opt out mechanisms when required. Coaching channels are not monitored as emergency services.
15. Electronic records and signatures
By typing a full legal name and affirmatively accepting the enrollment documents, the client consents to electronic contracting and intends the electronic signature to bind the client to the signed agreement. NSP provides an electronic copy of the signed agreement before opening Stripe Checkout.
16. Intellectual property and program use
NSP programs, written coaching materials, assessments, site content and internal methods are protected intellectual property. A client receives a personal, non transferable license to use materials for the client’s own coaching relationship. Programs may not be resold, publicly distributed or used to coach third parties without written permission.
17. Suspension or termination for safety or misconduct
NSP may suspend or terminate service for threats, harassment, unsafe conduct, fraud, payment failure, material misrepresentation, repeated disregard of safety instructions or conduct that materially disrupts coaching/facility operations. Any financial treatment remains subject to the signed agreement and applicable law.
18. Changes and conflicts
The version accepted at enrollment governs that transaction. If public website language conflicts with the electronically signed agreement for an existing client, the signed agreement controls to the extent permitted by law. We may update website terms prospectively; material changes affecting an existing paid relationship are handled through appropriate notice/acceptance where required.
