Privacy Notice

1. Scope
This Privacy Notice describes information handled by Next Standard Performance (“NSP”), operated by Sky Hood Ventures LLC, when you use this website, complete an assessment, request a consultation, enroll, pay, receive in person or online coaching, send a technique video, contact support, request cancellation or apply to coach with NSP.
2. Information we collect
Depending on how you interact with us, we may collect: name; email; phone; date of birth; service geography; schedule preferences; assessment answers; goals; training history; exercise preferences; injury/limitation information you choose or need to provide for coaching; lifestyle, sleep, stress and general nutrition information; program notes; technique videos or links you voluntarily send; consultation details; signed agreement records; IP derived security hashes; user agent/device information; marketing consent; subscription/customer identifiers; communication history; cancellation requests; and coach applicant information.
3. Information we intentionally do not require
NSP does not require progress photos, social media posts or public before/after content as a condition of service. A client may voluntarily provide an image/video when it is useful for coaching (for example, exercise technique), but that does not authorize public use.
4. Payment information
Payment card data is entered on Stripe’s hosted checkout and processed by Stripe. NSP receives transaction, customer and subscription identifiers and status information needed to administer the membership, but the website is not designed to store full card numbers.
5. How we use information
We use information to: provide and personalize coaching; assess service fit; build programs; schedule sessions/calls; communicate about service; process and verify billing; create/store signed contract evidence; respond to cancellation and support requests; maintain safety and business records; prevent abuse/fraud; operate the operations dashboard; improve services; send marketing only where authorized/permitted; and comply with legal obligations.
6. Technique videos and sensitive coaching context
Technique videos are used to critique training performance and may be retained for a reasonable period to provide the coaching relationship, document advice or maintain legitimate business records. Do not send highly sensitive medical records through ordinary coaching email/text channels. If detailed clinical information is needed, use an appropriate licensed medical provider/channel.
7. Service providers
NSP uses service providers to operate the business, including Netlify for website/function hosting, a Supabase/Postgres database environment for application records, Resend for email delivery and Stripe for payment/subscription processing. These providers process information for their respective services under their own terms and privacy practices.
8. Coaches and internal access
Authorized NSP staff or contracted coaches may access client information reasonably necessary to deliver or administer the service. Access should be limited to legitimate coaching/operational needs. Coach compensation and internal administrative records are not public client records.
9. Marketing communications
The assessment’s optional marketing consent box is separate from transactional/service communication. If you opt into assessment follow up, you may unsubscribe using the link in the email. We may still send non marketing messages necessary to administer an active membership, agreement, payment, schedule, support request or legal notice.
10. Client stories, testimonials and media
Membership enrollment is not a media release. NSP will not use a client’s identifiable photo, video, name, testimonial, measured result or transformation story in advertising merely because the person is a client. Any such use requires a separate affirmative authorization describing the intended use. Declining marketing/media use does not reduce service access.
11. Cookies, local storage and basic technical data
The site may use necessary cookies or browser storage for session security, admin authentication and saving an in progress assessment. We may collect ordinary server logs/security events to protect the service. If analytics or advertising technologies are added later, this Notice should be updated to accurately describe them before they are used.
12. Retention
We retain information for as long as reasonably needed to provide services, administer billing and agreements, maintain safety/business records, resolve disputes, prevent fraud and meet legal/accounting obligations. Different records have different legitimate retention periods. We do not promise deletion of a record when retention is reasonably necessary for an active contract, legal obligation or defense of a claim.
13. Security
We use administrative and technical measures appropriate to the service, including server side pricing, authenticated admin access, signed cookies, rate limiting, hashed security identifiers and third party payment processing. No internet or storage system can be guaranteed completely secure. If we learn of a security incident involving personal information, we will evaluate and respond in accordance with applicable law.
14. Disclosure of information
We may disclose information to service providers, authorized coaches/staff, professional advisers, insurers, facilities where necessary for service/safety, or government/law enforcement entities when legally required. We may also transfer business records in a bona fide merger, financing, sale or reorganization subject to appropriate confidentiality and applicable law.
As currently operated, NSP does not rent personal information and does not sell client information for money.
15. Your requests
You may contact us to request correction of inaccurate contact information, ask a privacy question, withdraw optional marketing consent or request deletion of information that is not required for an active service or legitimate legal/business purpose. We may need to verify identity before acting on a request.
16. Children
The public NSP membership service and checkout are for people 18+. The site is not intentionally designed to collect personal information directly from children for public membership enrollment.
17. Changes
We may update this Notice as the product or law changes. The current version/effective date will be posted here. Material changes affecting an active relationship will be handled through additional notice where appropriate.
